
Can I collect Unemployment Benefits if I quit a job that has not paid me in 4 weeks?
I work for a company in California, the company has not paid it’s employees in about 4 weeks now. The company is obviously not doing well financially, but they are giving employees money in an as need basis, which makes no sense to me. We have to go to management and ask that they give us money, that they owe us! I have been trying to reach the EDD office and of course can not get through. I was finally able to fill out an application online and hope that I can finally get an answer to my questions. a) Can I collect partial unemployment benefits, b) can I collect full benefits if I quit, due to not being paid on time and because of the financial struggle this puts on me?
The laws are different in each state. However, generally speaking, you cannot file for unemployment if you quit. It’s only for people who are laid off (not fired). I would wait to see what happens with your application. I wish I could be more help.
